These Terms of Service ("Terms") govern your use of Athora (the "app," "service"), a product of Pulse Development LLC, a Wyoming limited liability company ("Athora," "we," "us," or "our"). By creating an account or using Athora, you agree to these Terms. If you do not agree, do not use the app.
Athora is an AI-powered fitness app that analyzes physique photos, generates personalized workout plans, provides an AI coaching experience, and helps you track workouts and progress. Features may change, expand, or be discontinued over time.
Athora does not provide medical advice, diagnosis, or treatment. The body-composition estimates, scores, plans, and coaching provided by the app are for general fitness and informational purposes only and are generated in part by AI models. They are estimates, not clinical measurements.
Consult a qualified physician or healthcare professional before starting any exercise program, especially if you have a medical condition, are pregnant, are injured, or have concerns about your health. You are responsible for exercising safely and within your abilities. Stop and seek medical attention if you experience pain, dizziness, or other warning signs. You use all workouts and guidance at your own risk.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Athora.
You are responsible for the accuracy of the information you provide and for keeping your account credentials secure.
You are responsible for all activity that occurs under your account.
You retain ownership of the photos, messages, and data you submit ("Your Content").
You grant us a limited license to store, process, and use Your Content solely to operate and provide the service to you, including processing by our AI and infrastructure providers as described in the Privacy Policy.
You represent that you have the right to submit Your Content and that it does not violate any law or third-party rights.

Athora relies on third-party services, including authentication, database, and storage providers, AI model providers, and exercise-media sources. Exercise demonstration videos and thumbnails are streamed from third parties (such as MuscleWiki) and remain subject to those third parties' rights and terms. We are not responsible for the availability, accuracy, or content of third-party services.
If Athora offers paid features or subscriptions, applicable pricing and billing terms will be presented at the point of purchase and processed through the Apple App Store. Purchases are subject to Apple's terms, and renewals, cancellations, and refunds are handled according to those terms.
The app, including its design, software, and content (excluding Your Content and third-party content), is owned by Athora and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes.
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that estimates and recommendations will be accurate or suitable for you.
To the maximum extent permitted by law, Athora and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or physical injury arising from your use of the app. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50. Nothing in this section limits any liability that cannot be limited or excluded under applicable law.
You agree to indemnify and hold Athora harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of the app, your violation of these Terms, or your violation of any rights of a third party.
You and Athora agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the app will be resolved through binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court. This means you and Athora each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative action. The arbitration will be conducted by a recognized arbitration provider under its applicable rules, and will take place in the jurisdiction specified in Section 13 below, unless you and Athora agree otherwise.
You may stop using the app and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will continue to apply.
We may update these Terms from time to time. If we make material changes, we will update the effective date and, where appropriate, notify you in the app. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Subject to Section 12 (Dispute Resolution and Arbitration), any disputes not subject to arbitration will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.
